Month to Month Pool Service Agreement  (Revised 5/18/26)

This Agreement is provided on a month-to-month basis. Either party may terminate service with thirty (30) days written notice without cause. In certain circumstances, service may be discontinued immediately, including but not limited to non-payment, solicitation of our employees for private work, or unresolved pool or equipment issues that materially affect safe or proper service of the pool.

This Pool Service Agreement is entered into between Z Home Services LLC dba Puddle Pool Services Treasure Coast, “Puddle Pool Services” or “Puddle Pools” and you, the "Client". By enrolling in service, the Client agrees to the terms and conditions set forth below.

1. Scope of Services

Scheduled Maintenance Services

Puddle Pool Services will perform routine swimming pool maintenance services in accordance with the service plan selected by the Client. Routine services may include, but are not limited to:

Visual inspection of pool, spa, and related equipment

Skimming surface debris

Brushing pool walls, steps, and tile as needed

Vacuuming when conditions reasonably allow

Cleaning pump and skimmer baskets

Testing and balancing water chemistry within industry standards

Adding standard maintenance chemicals included in the service plan

Logging and documenting services performed

Noting visible concerns or recommended repairs

Filter cleaning (monthly)

The exact scope, service frequency, chemical inclusion, and pricing are defined in the Client’s Estimate for Services.

2. Service Frequency

Services will be performed according to the service plan selected at enrollment, such as weekly, bi-weekly, or monthly service. Puddle Pool Services does not guarantee a specific service day or time, only the service frequency within the applicable service period.  Every effort will be made to accommodate specific requests for days or times of services but they are not guaranteed.

3. Excluded and Additional Services

Routine maintenance does not include conditions that require excessive time, labor, materials, or multiple visits beyond normal maintenance standards within a 30 minute maximum visit by the technician. These conditions include, but are not limited to:

Salt cell cleanup

Suction side vacuum diagnosis / repair

Sand filter replacements

Cartridge filter replacement

Specialty chemicals (phosphate remover, algicide, stain removers etc.)

Pools excessively dirty due to storms, flooding, wind events, hurricanes, construction, landscaping, or neglect

Algae blooms or severe water imbalance requiring intensive treatment

Heavy debris removal beyond normal accumulation

Green, black, or otherwise severely contaminated pools

Equipment repair, replacement, or installation

Leak detection, plumbing, or structural issues

Emergency or same-day service requests

Specialized chemical treatments, drain and clean services, or deep cleanings

 

When excessive conditions are present, the technician may perform a limited service visit and document the condition. Additional services, cleanups, return visits, or restoration work may be required and will be quoted separately. Client authorization may be required prior to performing additional services when reasonably feasible.

Any potential additional charges will be cleared with the homeowner prior to treatment.

4. Service Scheduling and Access

Puddle Pool Services reserves the right to adjust service days due to holidays, severe weather, technician availability, illness, equipment failure, or other circumstances beyond reasonable control.

If a technician arrives for scheduled service and cannot safely or reasonably complete service due to any of the following, the visit will be documented as attempted:

Inaccessible or locked areas

Unsafe working conditions

Aggressive or unsecured pets

Equipment malfunction preventing service

Client-caused obstructions or hazards

In these cases, service will resume at the next scheduled visit. No refunds or credits will be issued for incomplete or missed services due to these conditions.

5. Client Responsibilities

The Client agrees to:

Provide safe, unobstructed access to the pool and equipment

Secure pets and remove hazards prior to service

Provide all necessary access codes, keys, or gate access

Maintain proper water levels between service visits

Promptly notify Puddle Pool Services of leaks, equipment malfunctions, or visible issues

Treat the Puddle Pools staff with respect at all times, any issues regarding services are to be addressed to the Puddle office staff first and not with your technician.  Verbal or physical abuse of Puddle Pools staff of any kind will not be tolerated and is grounds for immediate termination of service.

Failure to meet these responsibilities may result in incomplete service, additional charges, or delayed maintenance.

6. Payment Terms and Prepayment Requirement

All service plans are billed as a recurring monthly fee and are payable in advance.  We invoice on the 25th of every month for the upcoming month due on receipt.  A recurring payment method should be kept on file to avoid service disruption.  Your first service invoice will be pro-rated for the remainder of that month.

Payment for each service month must be received prior to the start of that service month. If payment has not been received by the first scheduled service day of the month, services may be suspended without further notice until the account is brought current.

No services will be performed on past-due accounts. Missed visits due to non-payment will not be credited or made up once payment is received.

7. Monthly Service Structure and Visit Variability

The Client acknowledges that pool service is billed as a monthly maintenance program and not per visit.

While service is typically performed on a weekly basis, the number of service visits in any given month may vary due to calendar structure, weather conditions, holidays, technician availability, or operational scheduling. Some months may include up to five service visits, while others may include fewer.

Puddle Pool Services reserves the right to skip or reschedule up to four (4) routine service visits per calendar year without refund or credit. These skipped or rescheduled visits may occur due to severe weather, hurricanes, holidays, staffing limitations, or other circumstances beyond reasonable control.

Service frequency will be managed to maintain the pool within normal maintenance standards over time.

The Client expressly waives any claim for refunds, credits, or damages arising from skipped, delayed, or rescheduled visits permitted under this Agreement.

8. Florida Weather and Acts of Nature

Florida weather conditions including hurricanes, tropical storms, heavy rain, flooding, wind events, lightning, extreme heat, and airborne debris are acts of nature beyond the control of Puddle Pool Services.

The Client acknowledges that such conditions may cause contamination, debris accumulation, algae growth, equipment damage, or chemical imbalance exceeding routine maintenance standards. Services required to restore the pool following such events are not included in routine service and may require additional visits with corresponding charges.
